Terms & Conditions
Welcome to Tumse.com.au (“Tumse”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile experience, and related services (collectively, the “Services”).
By creating an account, registering, subscribing, or otherwise using Tumse, you agree to these Terms and confirm that you have also read and understood our Privacy Policy. If you do not agree, do not use the Services.
These Terms are effective from 4th July 2021. We may update them from time to time. Continued use of the Services after changes are posted means you accept the updated Terms.
1. Eligibility
- You must be at least 18 years of age to use Tumse. Persons under 18 are not permitted to register or use the Services.
- You must provide accurate, current, and complete registration information.
- You may only create and maintain one personal account.
- You must not use Tumse if you have previously been banned or removed for violating these Terms.
2. Your account
- You are responsible for maintaining the confidentiality of your login details and for all activity under your account.
- You agree to keep your profile information, photos, and preferences reasonably accurate and up to date.
- You must not share your account with others or allow another person to use your login.
- Notify us promptly via our contact page or at admin@tumse.com.au if you suspect unauthorised access to your account.
3. The Tumse service
Tumse is an online dating and social matching platform that allows members to create profiles, browse and like other members, form matches, and communicate when a mutual match occurs.
- Sending a like (heart) notifies the other member. A match is created only when the feeling is mutual.
- We do not guarantee matches, responses, compatibility, or any particular outcome from using the Services.
- Features may change as we improve the platform. We may add, modify, or remove features at any time.
4. Subscriptions, trials, and payments
- Access and pricing may differ by user type. Women may access Tumse free of charge. Men may be required to subscribe to access full features.
- Where offered, a free trial (such as a 7-day trial) may apply. After the trial ends, paid subscription charges apply unless you cancel or delete your account before billing begins, where applicable.
- Paid membership is currently offered on a month-to-month basis (for example, $9.99 per month), charged from the date you start a paid subscription and then on the same date each month while your subscription remains active.
- Card and payment details are processed by our third-party payment provider. Tumse does not store your full credit or debit card number.
- Fees, trial length, and included features may change. Any material changes will be reflected on the site or communicated as appropriate.
5. Cancellation and account deletion
- You may delete your profile at any time through your account settings.
- When you delete your account, your payment subscription is automatically cancelled. You do not need to cancel billing separately.
- If you are charged after deleting your profile, email admin@tumse.com.au and we will arrange a refund where appropriate.
- We may suspend or terminate accounts that violate these Terms, applicable law, or that we reasonably believe pose a risk to other members or the platform.
6. Member conduct
You agree that you will not:
- Harass, threaten, stalk, abuse, defame, or harm other members.
- Post illegal, hateful, discriminatory, violent, sexually exploitative, or otherwise offensive content.
- Impersonate another person or misrepresent your identity, age, or intentions.
- Upload photos or content that you do not have the right to use, or that include other people without their consent.
- Use Tumse for spam, advertising, scams, commercial solicitation, or to collect personal data about other members.
- Attempt to hack, disrupt, scrape, reverse engineer, or interfere with the Services or other members’ accounts.
- Use bots, scripts, or automated tools to interact with the platform.
We may remove content, restrict features, or permanently ban accounts that breach these rules.
7. Content you submit
- You retain ownership of content you upload (such as photos and bio text), but you grant Tumse a non-exclusive, worldwide licence to host, display, and use that content as needed to operate and promote the Services.
- By uploading photos, you agree they may be shown to matches and other Tumse users as part of your profile.
- You are solely responsible for the content you post and for interactions you choose to have with other members.
8. Safety and interactions with other members
- Tumse does not conduct criminal background checks on all members and cannot verify every detail members provide.
- You are responsible for using caution when communicating, meeting, or sharing personal information offline.
- Report suspicious or abusive behaviour via our contact page so we can review and take appropriate action.
9. Intellectual property
Tumse, the Tumse name, logos, colours, images, design, and other marks are trademarks or protected materials of Tumse. You may not copy, modify, distribute, or use our branding or platform materials without prior written permission, except as needed for normal personal use of the Services.
10. Disclaimers
- The Services are provided on an “as is” and “as available” basis.
- We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
- We do not guarantee that you will find a match or that other members will behave appropriately.
11. Limitation of liability
To the maximum extent permitted by applicable Australian law, Tumse and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunities arising from your use of the Services or interactions with other members. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.
12. Privacy
How we collect, use, and disclose personal information is described in our Privacy Policy. By using Tumse, you acknowledge that policy.
13. Changes to the Services or Terms
We may update these Terms or modify the Services at any time. Where changes are material, we may highlight updates on this page. Your continued use after changes take effect constitutes acceptance of the revised Terms.
